By signing up to activate your account, you agree that the following terms and conditions will apply to the use of Virtual Sapiens (the “Service”) provided through www.virtualsapiens.co (the “Site”) by Virtual Sapiens, Inc. (“Virtual Sapiens”, “we” or “us”). If you do not agree and accept, without limitation or qualification, these Terms of Service, you must exit the Site immediately and abstain from using the Service.
By using the Site or Service, you represent and warrant that you are 18 years of age or older.
For our Presence Portal, when you sign up for and confirm your account, you will be given a choice of assessment to begin with. Once you select your preferred method for receiving personalized communication coaching, you will be asked for video and audio permissions. This will allow you to move through your selected video based assessment wherein our AI analyzes your video stream and audio in order to give you immediate feedback following the assessment experience.
Virtual Sapiens analyzes your video and audio in realtime. We do not record or store your video unless you explicitly request we do for your own review and improvement purposes. For video meetings and use of our Sidekick Coach, we do not have the option to save meeting video. We can optionally save a few screenshots of your non-verbal behaviors during your meetings.
Following any assessment, you will have access to your personal dashboard which is private to you. Once in your dashboard, you will find your assessment results and, if you have an unlocked account, a content library of video resources as well as progress tracking. Depending on your account subscription, you may also have access to take an unlimited number of assessments, at your leisure and convenience.
We agree that we shall not sell or distribute your video images to any unaffiliated third party for any commercial purpose or use the video materials and personalized feedback for any purposes other than providing you with consistent and personalized feedback and further development of the software.
For our Sidekick product, when you install the Sidekick Coach application, you will be asked for access to your calendar service. This allows your Sidekick Coach to auto-launch seamlessly during meetings so the onus is not on the user to launch this service. We use third party authentication to create your account and are compatible with Zoom, Microsoft and Google OAuth services. You will also be asked to provide access to your microphone and your webcam. This allows your Sidekick to provide you with in-call feedback on visual communication cues and vocal metrics like speaker share. Your Sidekick Coach includes a pre-call check as well as auto and manual launch of your Sidekick floating dashboard. This in-call dashboard leverages AI and ML models to provide personalized nudges and encouragements according to our presence points system. Following a call, the user will receive a post-call summary with feedback organized into communication themed buckets. For Sidekick Coach users, you will also have access to a personal dashboard, private to you, which contains all of your past meeting results in order to visualize your improvement over time. Sidekick Coach users also have access to our Learning Lab.
We do not store your meeting video or audio data and run our AI models locally in your browser. We can optionally save a few screenshots of your non-verbal behaviors during your meetings.
By creating any account and using our software, you grant us the irrevocable and unrestricted right to use and reproduce your video images in connection with the business activities of Virtual Sapiens and our affiliates, including for internal research, training and the development of new products or services. By using the Service, you release Virtual Sapiens from any and all claims and liability relating to our use of any video images or other information you submit through the Site, including any claim to profits that may arise from our internal use of said images or information, in accordance with the terms hereof.
For both Presence Portal and Sidekick Coach users, we leverage third party GenAI APIs to provide more advanced verbal analytics. This includes meeting summaries and takeaways and transcription-based analytics to help improve communication tenets like empathy and conciseness. This GenAI feature is optional and may be turned off by the user or upon request.
THE SITE AND THE SERVICE ARE PROVIDED ON AN “AS IS” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. VIRTUAL SAPIENS HEREBY DISCLAIMS ANY AND ALL WARRANTIES RELATING TO THE SITE AND SERVICE OR ANY OTHER MATTER COVERED BY THESE TERMS OF SERVICE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. VIRTUAL SAPIENS MAKES NO WARRANTIES OR REPRESENTATIONS AS TO THE ACCURACY, COMPLETENESS, RELIABILITY, OR SECURITY OF ANY CONTENT PROCESSED BY THE SITE OR SERVICE, OR THAT ANY SERVICE OR ITEMS OBTAINED THROUGH THE SITE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS. THE AGGREGATE LIMIT OF VIRTUAL SAPIENS’ LIABILITY IN CONNECTION WITH ANY AND ALL CLAIMS ARISING UNDER THESE TERMS OF SERVICE OR OTHERWISE IN CONNECTION WITH THE SITE OR THE SERVICE SHALL BE THE AMOUNT THAT YOU HAVE PAID TO VIRTUAL SAPIENS FOR BUSINESS FOR THE SERVICE.
Virtual Sapiens retains the right to terminate its provision of the Service to you for any reason at any time. Provided that such termination is not by reason of your breach of these Terms of Services, you will receive a refund of any amounts you have paid for the Service.
All matters relating to the Site, Service and these Terms of Service shall be governed by and construed in accordance with the internal laws of the Commonwealth of Massachusetts without giving effect to any conflict of law provisions thereof. Any lawsuit, action, or proceeding arising out of, or related to, the Site, Service or these Terms of Service shall be instituted exclusively in the state or federal courts located in Boston, Massachusetts.
